These Website Terms of Use ("Terms") govern your access to and use of this website (the "Website"), operated by K2026770168 (South Africa) (Pty) Ltd, trading as Distribution Partners Group ("DPG", "we", "us" or "our"), registration number 2026/770168/07.

By using the Website you agree to these Terms. If you do not agree, please do not use the Website.

1. About DPG and this Website

DPG is a distribution and marketing business that builds and manages consent-based referral channels connecting individuals, professionals and businesses with licensed financial advisers and other specialists.

DPG is not an authorised financial services provider and does not provide financial advice or intermediary services. Nothing on the Website is financial, investment, tax, legal or other professional advice, a recommendation or an offer of any financial product. Please read our Disclaimer.

2. Using the Website

You may use the Website for lawful purposes only. You must not:

• use the Website in a way that breaches any law, or that is fraudulent or harmful;
• submit false, misleading or another person's information through any form on the Website;
• submit any third party's personal information through the Website's forms (approved referral partners use dedicated channels for introductions);
• attempt to gain unauthorised access to the Website, its servers or any connected systems, or interfere with its operation (including by introducing malicious code or by automated scraping that places an unreasonable load on the Website);
• use the Website to send unsolicited communications; or
• copy, frame or reproduce the Website or its content except as permitted in section 4.

We may suspend or restrict access to the Website, or block submissions, where we reasonably believe these Terms have been breached.

3. Forms and enquiries

Submitting a form on the Website (including a referral partner enquiry) does not create a partnership, agency, employment or any other contractual relationship with DPG. Any referral partnership is subject to an onboarding process and a separate written agreement, which DPG may decline to enter into at its discretion.

Personal information submitted through the Website is processed in accordance with our Privacy Policy.

4. Intellectual property

The Website and its content, including text, graphics, the DPG name, logo and network motif, layout and software, are owned by or licensed to DPG and protected by intellectual property laws.

You may view and print pages from the Website for your personal or internal business reference, provided you do not modify them and you keep any copyright and proprietary notices. You may not otherwise use, reproduce, distribute or create derivative works from the Website's content, or use DPG's name or logo, without our prior written consent.

5. Accuracy of information

We take reasonable care to keep the Website accurate and up to date, but the information on it is general in nature, may change without notice and is provided "as is". We do not warrant that the Website will be uninterrupted, error-free or free of viruses or other harmful components.

6. Third-party websites

The Website may contain links to third-party websites, such as the Information Regulator's website. We provide these links for convenience only. We do not control, endorse or accept responsibility for third-party websites, their content or their privacy practices.

7. Limitation of liability

To the fullest extent permitted by law, DPG, its directors, employees and agents will not be liable for any direct, indirect, special or consequential loss or damage arising from:

• your use of, or inability to use, the Website;
• reliance on any information on the Website;
• any advice or service provided by a licensed professional or other third party, including one to whom you were introduced; or
• any interruption, delay, error, virus or unauthorised access affecting the Website.

Licensed financial advisers to whom introductions are made provide advice only as, or as representatives of, authorised financial services providers, and are solely responsible for the advice and services they provide. One of DPG's directors is such an adviser; see section 3 of our Disclaimer.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded by law, including any rights you may have under the Consumer Protection Act 68 of 2008 where that Act applies, or liability for gross negligence or wilful misconduct.

8. Indemnity

You indemnify DPG against any loss, damage, claim or cost (including reasonable legal costs) arising from your breach of these Terms or your unlawful use of the Website.

9. Electronic communications

Communications between you and DPG through the Website or by email are governed by the Electronic Communications and Transactions Act 25 of 2002. A data message is regarded as received by DPG only when we acknowledge receipt or respond to it.

10. Changes to these Terms

We may amend these Terms from time to time by publishing the updated version on the Website. The version published at the time you use the Website applies. Please check this page regularly.

11. General

• Governing law. These Terms are governed by the laws of the Republic of South Africa.
• Jurisdiction. You consent to the jurisdiction of the High Court of South Africa, Gauteng Division, Johannesburg, without prejudice to DPG's right to approach any other competent court.
• Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force.
• No waiver. Any indulgence or delay by DPG in enforcing these Terms does not waive its rights.
• Whole terms. These Terms, together with the Privacy Policy, Cookie Policy and Disclaimer, are the whole of the terms governing your use of the Website.
